TERMS AND CONDITIONS – RIDE WITH MM
1. General
1.1 These Terms and Conditions govern the rights and obligations of participants of all experience programs titled “Ride with Martin Macík”, operated and provided by MMP Agency s.r.o., ID No. 19638604, with its registered office at Mikulandská 119/10, 110 00 Prague 1, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 389573 (hereinafter referred to as the “Organizer”). Martin Macík participates as a personality/performer represented by the Organizer.
1.2 By submitting an order or purchasing a voucher, a contract for the provision of services is concluded between the participant and the Organizer in accordance with Section 1746(2) of the Czech Civil Code. These Terms and Conditions form an integral part of that contract.
2. Reservations and Vouchers
2.1 The experience voucher is transferable and valid for 12 months from the date of purchase, unless otherwise stated on the voucher.
2.2 The participant selects the date of the program from the options offered by the Organizer or by mutual agreement.
2.3 After the voucher expires without being used, the participant is not entitled to a refund or extension, unless expressly approved by the Organizer.
2.4 Purchased vouchers are non-refundable, except in cases of individual approval by the Organizer.
2.5 When a voucher is transferred to another person, all related rights and obligations are transferred to the new holder.
3. Changes and Cancellations by the Organizer
3.1 The Organizer reserves the right to change or cancel a scheduled date due to circumstances beyond its control (in particular adverse weather conditions, technical issues, health indisposition of performers, safety risks, or force majeure).
3.2 In the event of cancellation, the Organizer will offer the participant an alternative date.
3.3 If the participant declines the alternative date, the voucher remains valid until the end of its validity period.
4. Cancellations by the Participant
4.1 Cancellations made at least 30 days prior to the scheduled date are free of charge.
4.2 If the participant cancels less than 30 days before the event, the right to a refund or rescheduling is forfeited, unless otherwise decided by the Organizer.
5. Safety and Health Conditions
5.1 The participant must follow all instructions given by the Organizer or authorized personnel. Such instructions take precedence over any directions from other participants.
5.2 The participant and their accompanying persons attend the program at their own risk. The participant must be in good health and is fully responsible for their own fitness to participate.
5.3 The Organizer reserves the right to exclude any person under the influence of alcohol, drugs, or any other intoxicating substances, or anyone who is clearly unfit to participate. In such cases, no refund will be provided.
5.4 The Organizer is not liable for any damage resulting from a participant’s failure to follow instructions or for loss of personal belongings, unless it is proven that the Organizer was at fault.
6. Audiovisual Recordings, Images, and Accompanying Persons
6.1 The Organizer is entitled to make audiovisual recordings (photos, videos, sound, or other media) during the event, which may include participants and their accompanying persons.
6.2 By attending the event, the participant and their accompanying persons expressly consent to the use of such recordings and images by the Organizer, free of charge, for documentation, promotional, and marketing purposes (website, social media, press, television, etc.), without time or geographic limitations.
6.3 The Organizer may edit, combine, or include the recordings in other works. The participant is not entitled to compensation for such use.
6.4 If a participant or their accompanying person wishes to request the removal of a specific recording, they may submit a written request to info@martinmacik.com. The Organizer will review the request and comply to a reasonable extent.
7. Personal Data Protection (GDPR) and Marketing
7.1 The Organizer processes personal data of participants and their accompanying persons in compliance with Regulation (EU) 2016/679 (GDPR).
7.2 Personal data is processed for the purposes of reservations, communication, accounting, and marketing (sending information about events, offers, and news related to the Organizer and associated projects).
7.3 Participants may withdraw their consent to marketing processing at any time by sending a request to info@martinmacik.com. Withdrawal of consent does not affect the lawfulness of processing carried out prior to withdrawal.
7.4 Personal data is shared only with necessary processors (invoicing, IT, legal services) or authorities as required by law.
8. Complaints and Claims
8.1 Any complaints regarding services must be submitted in writing to info@martinmacik.com within 7 days after the event, including a description of the defect or reason for the complaint.
8.2 The Organizer will process the complaint without undue delay, no later than 30 days from receipt.
9. Force Majeure
9.1 The Organizer is not liable for delays or failures caused by force majeure (natural disasters, epidemiological restrictions, government interventions, transportation issues, or other unforeseeable events).
9.2 In such cases, the participant will be offered an alternative date.
10. Governing Law and Jurisdiction
10.1 These Terms and Conditions are governed by the laws of the Czech Republic.
10.2 Any disputes arising from these Terms and Conditions shall be resolved before the competent court in Prague, according to the registered seat of the Organizer (MMP Agency s.r.o.).
11. Effectiveness
11.1 These Terms and Conditions take effect on the date of their publication on www.martinmacik.com.
TERMS AND CONDITIONS – BUSINESS EVENTS, INSPIRATIONAL TALKS, TALK SHOWS
1. General
1.1 These Terms and Conditions govern the relationship between the client (a legal entity or self-employed individual) and the provider MMP Agency s.r.o., ID No. 19638604, with its registered office at Mikulandská 119/10, 110 00 Prague 1 (hereinafter referred to as the “Organizer” or “Provider”) regarding the booking of corporate programs, performances, talks, talk shows, presentations, trainings, or similar events featuring or involving Martin Macík.
1.2 These Terms and Conditions form an integral part of the order or service agreement, unless otherwise agreed in writing.
2. Scope of Services
2.1 The Organizer undertakes to deliver the agreed program within the specified scope, date, location, and for the agreed price, including the participation of agreed persons (e.g., Martin Macík). Details such as the program content, technical requirements, and schedule are specified in the offer or order.
3. Price and Payment Terms
3.1 The price is agreed individually based on the offer and confirmed order.
3.2 Invoices are payable within the period stated on the invoice (typically 14 days), unless otherwise agreed in the contract.
3.3 In case of delayed payment, the Provider is entitled to charge statutory default interest in accordance with applicable legislation.
4. Cancellations and Fees
4.1 Cancellations by the client are governed by the contract; unless otherwise stipulated, the following applies:
a) Cancellation more than 30 days before the event: 0% cancellation fee (or as individually agreed).
b) Cancellation less than 30 days before the event: 50% of the agreed price.
c) Cancellation less than 7 days before the event: 100% of the agreed price (full payment due).
4.2 If the Organizer cancels the event due to force majeure or reasons beyond its control, the Organizer will consult with the client. If an alternative date is provided, a credit note will be issued only to the extent mutually agreed.
5. Client’s Obligations
5.1 The client shall ensure suitable premises, technical facilities, access, safety conditions, and all necessary permits for the event, unless otherwise agreed.
5.2 The client is responsible for fulfilling all public-law obligations of the event organizer (insurance, permits, safety compliance, capacity limits, data protection of attendees, etc.), unless the contract specifies that such responsibility lies with the Organizer.
6. Audiovisual Recordings and Rights
6.1 The Organizer, or a third party authorized by the Organizer, may make audiovisual recordings of the event for documentation and promotional purposes.
6.2 The client agrees that such recordings may be used by the Organizer for the presentation and promotion of Martin Macík and MMP Agency s.r.o., without time or territorial limitation, unless otherwise stated in the contract.
6.3 The rights to any recordings created under the contract shall be governed by the contract; unless otherwise agreed, the Organizer reserves the right to use them.
7. Personal Data Protection
7.1 Both parties agree to comply with GDPR. Personal data of participants will be processed for the purposes of contract performance, communication, and marketing where a lawful basis exists. The conditions of data processing are described in the Privacy Policy available on the website or in the contract.
7.2 Data transfers to third countries are permitted only with the data controller’s consent and under the conditions required by law.
8. Intellectual Property
8.1 All materials, presentations, recordings, and creative outputs produced by the Organizer remain the property of the Organizer, unless otherwise stated in the contract.
9. Liability and Insurance
9.1 The Organizer is responsible for duly providing the services agreed upon in the contract.
9.2 Both the client and the Organizer shall arrange appropriate insurance (liability coverage) based on the nature and scale of the event.
9.3 The total liability of the Organizer may be contractually limited unless otherwise agreed; however, such limitation shall not apply to damage caused intentionally or through gross negligence.
10. Governing Law and Jurisdiction
10.1 These Terms and Conditions are governed by the laws of the Czech Republic.
10.2 Any disputes arising from these Terms and Conditions shall be resolved before the competent court in Prague, according to the registered seat of MMP Agency s.r.o., unless otherwise agreed in writing.
11. Effectiveness
11.1 These Terms and Conditions take effect on the date of publication or as stated in the respective order or contract.
